OFFICIAL RULES

  1. Sponsor. The KOHOxFidoXtra Contest (“Contest”) is sponsored by Koho Financial Inc. (“Sponsor”). This contest is in no way sponsored, endorsed or administered by Rogers Communications Inc. or one of its partners or subsidiaries or affiliates including Fido. Any questions, comments or complaints regarding the contest must be directed to Sponsor and not to Fido.

  2. Contest Dates and Times. The Contest begins on May 25, 2023 at 12:00am EST and ends on June 16, 2023 at 11:59pm EST (“Contest Period”) after which no further entries will be accepted.

  3. Eligibility. The Contest is open to legal residents of Canada who have reached the age of majority in their province or territory of residence and are not a KOHO User (i.e., You have not yet signed up for an account on koho.ca or as a user of the KOHO Financial mobile application (the “KOHO App”) except for the following parties (“Contest Parties”): employees, representatives, mandataries, or agents (and those living in the same household) of the Sponsor, its subsidiaries, affiliates, prize suppliers, advertising/promotion agencies and any other entity involved in the development, production, administration, or fulfillment of the Contest. By participating in the Contest, you agree to comply with and be bound by these Rules. Failure to comply with any of the Rules may result in disqualification. The Sponsor’s decisions regarding any aspect of the Contest, including without limitation the eligibility of Entries, are final and binding on all entrants in all matters related to the Contest.

  4. How to Enter. To enter the Contest, you must sign up for a KOHO account using the referral code FIDOKOHO and load funds (no minimum amount required) onto your new account. You will receive one contest entry (“Entry”) for successfully signing up for a new KOHO account with the referral code FIDOKOHO and loading any amount of funds onto your new KOHO account by 11:59pm EST on June 16, 2023. Limit of one Entry per person.

    Free Entry Option. NO PURCHASE NECESSARY. To enter the Contest without signing up for a KOHO account and loading funds, an eligible entrant must send an email to [email protected] with the subject line: “Free FIDOxKOHO Contest Entry” and include in the body of the email: (i) the entrant’s legal first name and last name (as it appears on a valid, unexpired government-issued ID), (ii) the entrant’s date of birth, and (iii) a 100 word or more unique and original essay written by the entrant (the entrant must not copy their essay from any third party, or any part thereof, nor submit that same essay, or any part thereof, more than once including submitting it to any other KOHO sponsored contest in the future) on the topic of Why you are excited about KOHO (collectively, “Free Entry Request”). Limit of one Free Entry per person. Essays which are not unique and original or which do not reflect the essay theme above are void. To be eligible, Free Entry Requests must be submitted and received by the Sponsor in accordance with these Rules by 11:59pm EST on June 16th, 2023.

    Any attempt or suspected attempt to use robotic, automatic, programmed or otherwise illicit means to enter the Contest, or any other methods not authorized by these Rules, for example, but not limited to, creating multiple accounts, identities, email addresses, or registrations, all in the Sponsor’s sole discretion, shall be deemed as tampering and may disqualify you from entering, participating and/or winning a prize.

  5. Prizes. Total of 3 prizes available to be won as follows:128 GB iPhone 14 Max Pro plus $500 cash loaded onto KOHO card (3 winners). Approximate retail value of each prize is $2,049. Limit of one prize per person. Prizes must be accepted as awarded. All winners assume any and all liability for any injury or damage caused, or claimed to be caused, by entering, participating in this Contest or the use or redemption of a prize. Sponsor reserves the right to substitute an alternate prize of equal or greater value if an advertised prize is unavailable at the time of award.

  6. Winner Selection and Confirmation. On June 19, 2023 at 12:00pm EST, Sponsor will conduct a random draw from all eligible Entries (including Free Entries) received during the Contest Period and select the potential winners (“Selected Entrants”). Selected Entrants will be deemed winners if they meet all of the eligibility criteria set out in these Contest Rules. If a Selected Entrant does not meet the eligibility criteria, this person will be disqualified and will not receive a prize and another entrant will be selected by way of a random draw from the remaining eligible Entries. Before being declared a winner, Selected Entrants will be required to: (i) correctly answer without assistance, the Sponsor’s time-limited mathematical skill-testing question to be administered via the Winner Release, or during a pre-arranged telephone call, email or other communication; (ii) sign and return the Sponsor’s Declaration of Eligibility and Liability/Publicity Release form (“Winner Release”); and (iii) comply with all other Rules. Sponsor may request Selected Entrants provide proof of eligibility (e.g., a copy of government issued identification to verify the entrant’s identity) to the satisfaction of Sponsor prior to Sponsor awarding a prize to such Selected Entrant.

    Odds of Winning. The odds of winning a prize will depend on the number of eligible Entries received during the Contest Period and the number of remaining prizes.

    Notification. The Sponsor will notify Selected Entrants within 2 business days of the draw and will be contacted by direct message to their KOHO account in the KOHO mobile application and/or via email (as determined by the Sponsor in its sole and absolute discretion). Up to three attempts will be made to contact Selected Entrants within 5 business days following the draw. A Selected Entrant that does not or cannot accept a prize may be forfeited and a new Selected Entrant selected by random draw, in the Sponsor’s sole discretion. Each Selected Entrant is solely responsible for monitoring their KOHO account and email account for such notification message(s). A signed copy of the Winner Release must be received by the Sponsor no later than 2 business days after initial email is sent by Sponsor notifying the Selected Entrant of being a potential winner failing which, the Selected Entrant will forfeit their prize. Sponsor is not responsible for the failure for any reason whatsoever of a Selected Entrant to receive notification or for the Sponsor to receive a Selected Entrant’s response. Proof of identification must be provided upon request. Prize will be delivered to winners by adding the applicable prize amount to the winner’s KOHO spendable account (or via e-transfer to any winner that entered using a Free Entry) and mailing the 128 GB iPhone 14 Max Pro to the winner’s specified mailing address.

  7. Winner Release. In order to be declared a winner and awarded a prize, the Selected Entrant must sign the Winner Release to: (i) confirm compliance with all Rules; (ii) agree to accept prizes as awarded; (iii) authorize the Sponsor to publish and otherwise use their name, city/town/village and province/territory of residence, photograph, voice and any other likeness, in connection with any promotion, publicity, or for general news, entertainment or information purposes without additional compensation to the potential winner; and (iv) release the Contest Parties and each of their respective officers, directors, employees, agents, representatives, successors and assigns (collectively, the “Released Parties”) from any and all liability in connection with this Contest, their participation therein or the awarding and use of the Prize.

  8. Limitation of Liability. None of the Released Parties are responsible for: (i) inaccurate entry information that may affect a person’s ability to participate in the Contest or be awarded a prize, including but not limited to human error, technical malfunctions, lost or delayed entries for any reason, mail failures, omission, or any combination thereof, and entries that fail to fully comply with the Rules; (ii) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (iii) lost, incomplete, delayed, mutilated, illegible or misdirected Entries (including Free Entries) or Winner Releases; (iv) injury or damage to entrants’ computers or to any other individual’s computer related to or resulting from participating in, or downloading any material regarding the Contest or accepting a prize; (v) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Contest; (vi) the security or privacy of information transmitted via computer networks or for privacy breaches due to interference by third-party computer hackers or otherwise; or (vii) late, lost, misdirected or unsuccessful efforts to notify a potential winner.

  9. A list of winners may be obtained by emailing the Sponsor at [email protected] Attention: Marketing, on or after June 30, 2023.

  10. Law. The Contest is void where prohibited by law and is subject to all applicable Canadian federal, provincial, territorial, and municipal laws. This Contest shall be governed exclusively by the laws of Ontario, without giving effect to any choice of law or conflict of law rules. Any dispute shall be adjudicated by the courts sitting in Toronto, Ontario.

  11. Rule Amendments. The Sponsor reserves the right, subject only to the approval of the Régie des alcools des courses et des jeux (“Régie”) in Quebec, to amend or modify these Rules, or modify, cancel or suspend the Contest, without prior notice for any reason whatsoever, including without limitation if any cause beyond the reasonable control of the Sponsor corrupts, or threatens to corrupt, the security or proper administration of the Contest.

  12. Privacy. By entering the Contest, you consent to the Sponsor storing, sharing and using the personal information submitted with your Entry for the purpose of administering the Contest and in accordance with Sponsor’s privacy policy.

  13. Conflict. In the event of any discrepancy or inconsistency between the terms and conditions of these Rules and disclosures or other statements contained in any Contest related materials, including but not limited to point of sale, television, print or online advertising, the terms and conditions of the Rules shall prevail, govern and control.

  14. Intellectual Property. All intellectual property, including but not limited to trade-marks, trade-names, logos, designs, promotional materials, web pages, source codes, drawings, illustrations, slogans and representations are owned by the Sponsor. All rights are reserved. Unauthorized use of any intellectual property without the express written consent of the Sponsor is prohibited.

  15. For Quebec residents only. Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the board only for the purpose of helping the parties reach a settlement.
